• RG Kar rape and murder: Calcutta HC judge seeks clarification on hearing probe plea

  • A Calcutta High Court judge on Tuesday advised the parents of the RG Kar rape-and-murder victim to seek a clarification from the division bench headed by Chief Justice T.S. Sivagnanam on whether the single-judge bench could hear their plea seeking a fresh investigation.

    “You have got to take this matter to the division bench (headed by the chief justice),” Justice Tirthankar Ghosh told the parents.

    “The difficulty I would be facing if I take up the matter is that if some other superior court is monitoring the investigation, there will be a lack of judicial discipline. Had it been a criminal revision, I could have understood,” Justice Ghosh said.

    “What is hurting my conscience is that two superior courts are looking into the matter.”

    The high court division bench of Chief Justice Sivagnanam and Justice Hiranmay Bhattacharyyahad transferred the probe from Kolkata Police to the CBI.

    After the central agency started the probe, a bench of the Supreme Court headed by the then Chief Justice of India, D.Y. Chandrachud, decided to take suo motu cognisance of the case. The bench has been monitoring the probe since.

    Lawyer Sudipta Maitra, appearing for the victim’s parents, said: “We never sought a CBI investigation. We said ‘let there be a proper investigation before the high court division bench’. The bench ordered a CBI probe.”

    The CBI counsel said a chargesheet has been filed and further investigation is on.

    “We are seeking clarity on the questions that have remained unanswered,” the victim’s father told The Telegraph.
