• Stay on probe not fetter on hearing bail plea: HC

  • Kolkata: Calcutta High Court on Thursday held that the HC stay on further investigation into 47 FIRs lodged by Nandigram police against individuals would not be a fetter on the subordinate court to hear bail petitions of the accused in custody.

    Two among those arrested moved the HC stating that the subordinate court had declined to hear their bail prayers on the ground that the HC was hearing the matter and had stayed further probe.

    Justice Rajarshi Bharadwaj held that the July 2 high court order would not come in the way of hearing bail petitions.

    Justice Amrita Sinha had on July 2 ordered an interim stay on further investigations into the 47 FIRs, lodged by Nandigram police in 40 days prior to and a little after the Lok Sabha elections, till the court heard out the petitioners and the state.

    The petitioners had prayed for quashing of the FIRs and staying of the proceedings on grounds that most of the FIRs were “open-ended” and 34 of the 47 were scribed by the same person, Md Basir Ahmad.
