• ‘Suspension of portal can’t stop teacher transfer on med ground’

  • Kolkata: Suspension of Utsashree (teacher transfer) portal cannot curtail the statutory right of a teacher to get transferred on medical ground, Calcutta High Court said recently.

    A teacher, suffering from a rare disease called Guillain Barre Syndrome, had applied for transfer to a school near his home to pursue treatment without any hindrance on Sept 30, 2022.The application was not forwarded by authorities of Bilweswar High School in East Burdwan to District Inspector of Schools on the ground that the portal was suspended.

    It was further informed that as soon as the suspension is lifted, a “no objection” would be issued. The suspension of the portal was extended till Dec 31, 2024. It was further stated that the petitioner was not the single teacher of geography in the school.

    Referring to orders by other benches of the HC in several other transfer matters, which clarified that the right of teacher to apply for transfer on medical grounds cannot be curtailed due to suspension of the portal, the court directed the school to issue “no objection” and forward the application to District Inspector of Schools in seven days.
