A single judge bench of the Calcutta High Court on Tuesday told the counsel of the parents of RG Kar rape-murder victim to seek a clarification from the bench of Chief Justice T S Sivagnanam whether it could hear their petition seeking further probe.

The parents of the junior doctor who was raped and murdered on the premises of the RG Kar hospital in Kolkata in August had filed a petition in the High Court seeking a fresh probe saying they have no confidence in CBI’s ongoing investigation into the case.

Justice Tirthankar Ghosh, before whose bench the matter was moved, said since the bench presided by Chief Justice T S Sivagnanam had ordered a CBI probe into the rape and murder of the junior doctor, the petitioner should obtain clarification from it as to whether he can hear the petition.

He also noted that the Supreme Court was already seized of several aspects of the matter after taking the case suo motu.

During the hearing, the CBI’s counsel told the court that a chargesheet in the case has already been filed and three status reports on the probe have also been submitted at “regular intervals”.

The parents’ counsel submitted that they are not standing in the way of the ongoing trial but would like an investigation into those aspects which have “not been investigated” by CBI. Urging the court to order a fresh investigation “soon”, the counsel claimed that all the evidence “has disappeared in the name of this investigation”.

The High Court will hear the matter on January 15 before which the clarification should be obtained, the judge said.

The CBI has filed a chargesheet against the prime accused in the case, Sanjay Roy, who worked as a civic volunteer with the local police. — With PTI
