Kolkata: Calcutta High Court on Thursday directed the East Kolkata Wetlands Management Authority (EKWMA) to take steps against encroachment of vested land under the Ramsar site within 12 weeks from the date of the order.
A division bench of Chief Justice T S Sivagnanam and Justice Hiranmay Bhattacharyya noted that the chief technical officer of the EKWMA lodged an FIR on the reported encroachment on June 17, '19. The petitioner claimed police investigated into the FIR and filed a charge sheet on Sept 2, 2019. The division bench noted that the authorities didn't take any step against the illegal activities since then.
The CJ put on record a three-storey building came up on EKW under Khatian 1 and a permanent boundary wall was built around it. The division bench observed under Sec 4 of the EKW (Management and Control) Act, 2006, the chief technical officer was authorized to undo construction and billboards found illegally erected within EKW.
The division bench directed the petitioner to appear in person before the chief technical officer along with a copy of the HC order and the directions earlier, and seek action against the encroachment.
