In a Sealdah district court hearing, the defense lawyer for Sanjay Roy, the accused in the rape and murder of a PGT doctor, questioned the crime scene and presented forensic evidence suggesting a lack of struggle. KOLKATA: The lawyer representing Sanjay Roy, the civic volunteer arrested for the rape-and-murder of a PGT doctor at RG Kar, raised questions about the place of occurrence of the crime as they argued at the Sealdah district court on Saturday, citing the victim's post-mortem report.
Roy, who had earlier claimed he was framed, is the only person whom the CBI has so far named for committing the crime. Roy's lawyer, Sourav Bandyopadhyay, presented excerpts from the Central Forensic Science Laboratory report, which could not find any sign of struggle on the mattress on the wooden dais, where the doctor's body was found lying in an "awkward position..." on Aug 9. The report stated that evidence of a possible struggle between the victim and her assailant was missing in the area of occurrence.
The report also mentioned that, except on the mattress, no biological stain could be detected on, around or underneath the wooden stage or the wooden table nearby. No biological stain was found on the floor of the place of occurrence either. A few long hair strands were recovered from the wooden table and mattress. Results from CFSL Kolkata and Chandigarh corroborated that some short hair strands found at the place of occurrence belonged to prime accused Roy.
In another observation in the report, the forensic lab noted that the corridor leading to the seminar hall was attended by doctors and nurses 24X7, and there was "less possibility" that someone could enter the seminar hall unnoticed and commit the offence. Roy's lawyers also questioned the mode of strangulation, based on the post-mortem report.
Even as the court heard arguments, lawyers for the victim's parents appeared and submitted a sealed envelope. The envelope reportedly contained names of some more persons who were allegedly involved in the crime and 35 points, indicating the involvement of others. "The investigation by CBI and Kolkata Police shows that many other persons were involved in the crime. All of the culprits cannot be arrested if there is no further investigation. They ate together. Where are the containers? The post-mortem was carried out in a perfunctory way," said Tarit Ojha, lawyer for the victim's family.
