12 Kolkata: A Calcutta High Court judge on Wednesday released a case on alleged corruption in appointments within the Gorkhaland Territorial Administration (GTA) after the advocate general pointed out that the matter did not fall under his court's jurisdiction.
Justice Biswajit Basu released the case a day after directing the virtual appearance of deputy inspector general (DIG) of the CID in this regard. The DIG CID appeared on Wednesday.
Former state education minister Partha Chatterjee, Trinamool functionary Trinankur Bhattacharya, and former GTA chairperson Binay Tamang were mentioned in the FIR. Justice Basu asked the DIG CID whether the accused had been served notices under Section 41A of the CrPC or Section 35 of the Bharatiya Nagarik Suraksha Sanhita.
During the hearing, advocate general Kishore Datta said that Justice Basu's court did not have jurisdiction over the matter. The case was subsequently referred to the chief justice of the Calcutta High Court, who will assign it to an appropriate bench for further hearing.
