• HC on security PIL: Let state work as per statute

  • Kolkata: The Calcutta High Court on Wednesday refused an urgent hearing of a PIL, seeking the deployment of state police at the Jadavpur University entrance gates for the time being, instead of private agency personnel currently on the job. The HC stated that it would not instruct the state on how to exercise its powers under the university statute.

    "The university has been created under a statute. Let the govt exercise the power granted to them under the statute. We are not here to tell them how to exercise that power. Let this come up next week," Chief Justice T S Sivagnanam told the lawyer.

    The matter was mentioned before the division bench of CJ Sivagnanam and Justice Chaitali Chatterjee (Das) for the second time, seeking an urgent hearing on Thursday. The lawyer stated that on the day "a particular political party" allegedly tried to gatecrash the university, the security personnel at the entrance, who belonged to private agencies, were beaten up. The lawyer prayed for state forces to ensure security at the university gates instead of the security personnel from private agencies who currently guarded the entrances to the university.

    The Chief Justice said that the matter concerned internal administration. "Can the court, say please, hand over your house keys to Mr Galib till 5 pm and then return it? It's better that the third-party forces do not enter this controversy. The matter will be resolved. They are all students, something has happened, some political personality has gone, then there was some commotion, cases have been registered, parents of the injured are also giving interviews. The state has to take action," CJ Sivagnanam said.

    The lawyer said police had stated they stood outside the university as they were not allowed to enter. He mentioned the university had closed down because of the students' protest.
