• Kolkata rape-murder: High Court asks CBI to submit case diary

  • THE CALCUTTA High Court on Friday, during a hearing in the RG Kar rape and murder case, asked the Central Bureau of Investigation (CBI) to submit the case diary in connection with the first five days of the investigation by the Kolkata Police.

    The court has ordered that the list of witnesses that the CBI have summoned till date should also be produced before the court as well as the opinions of the forensic experts that were taken by the CBI.

    The court has asked the CBI to inform the court on the next date as to why the CBI is taking so long to complete the investigation. The CBI submitted a status report on Friday in Justice Tirthankar Ghosh division bench as asked by the court on the previous day.

    The CBI counsel Rajdeep Majumdar submitted that this was not a case of gangrape, saying “A 14-member doctor medical board was constituted and all these doctors have stated that it is not a case of gangrape.”

    The CBI said that they are looking into the “destruction of evidence” and that the investigation is still on. There are voluminous documents collected, all call data details scrutinised. “We are looking at post offence conduct. DNA profiling has been done of one person (Sanjoy Roy ) as there is only one male DNA, no other samples found. We have done polygraph tests and have also recorded the 161 statement of the convict. We have also investigated all nurses, doctors and everyone associated with the hospital.”

    Meanwhile, the state government counsel Kalyan Banerjee submitted, “The destruction of evidence is a completely new aspect. The investigation into the rape and murder had concluded and chargesheet has been filed. Therefore, there cannot be further investigation. Destruction of evidence post crime is a new case, not this one. Trial has concluded in this case.”

    The matter will be heard next on April 23 by the Calcutta High Court.
