The Calcutta High Court on Wednesday ordered a private hospital in Kolkata to submit medical records of the deceased trainee doctor’s mother, who sustained injuries during the Nabanna Abhijan rally earlier this month, which was taken out to protest the rape and murder of the trainee doctor at RG Kar Hospital last year.

The order came after the court considered police reports from two police stations and the hospital’s medico-legal form.

The case dates to August 9, the first death anniversary of the RG Kar doctor, when the victim’s parents held the Nabanna Abhijan rally. The father had filed online complaints at two police stations in Kolkata seeking them to be treated as FIRs. He alleged that his wife had been attacked by police during a lathi charge. The doctor’s mother was taken to a private hospital and later discharged.

A single-judge bench of Justice Tirthankar Ghosh heard the matter after the state placed on record the two reports of the police stations. As per the first report, an inquiry found that “there was no ground to proceed any further with the case as there was no substance.”

The second police station report stated “outcome of preliminary enquiry is completed and no evidence or materials substantiating the allegation, thus no case was made out to lodge an FIR and the information was given to the Petitioner.”

The private hospital produced a medico-legal report and after examining it the court directed the hospital be made a party to the case. The court ordered the hospital to be represented and to make available all medical documents.
