KP, Noida cops face off over fake police stn search

Kolkata: A jurisdictional tussle erupted between Beleghata PS cops and Noida police over a search operation, which culminated in a courtroom confrontation on Wednesday.
The incident occurred when a team from the Noida Police arrived in Beleghata to search the residence of former Trinamool functionary Bibhas Adhikari, allegedly embroiled in a case of the establishment of a fake police station.
The Noida Police, claiming they had come with a search warrant from their local court, found themselves at an impasse when they found a locked flat and were unable to locate the key. This was the same flat out of which Adhikari reportedly tried to operate a fake police station just like in Noida. The Beleghata cops, however, insisted that no court order was initially presented to them.
The situation escalated when Beleghata cops allegedly prevented the Noida cops from breaking the lock, insisting that they needed to secure permission from the Sealdah court to proceed.
This led the Noida police to seek judicial intervention, prompting a hearing at the Sealdah Court. During the proceedings, the court verbally clarified its stance, stating that it lacked the jurisdiction to grant such permissions and reminded the police of their inherent authority to conduct searches if a warrant was in place.
The judge also questioned the necessity of court permission in urgent situations, such as apprehending a suspect, effectively reprimanding the police for their procedural hesitance. The Sealdah Court advised them to seek authorisation from the appropriate local court if Beleghata cops continued to object to breaking the lock.
