Kolkata: Calcutta High Court on Friday refused bail to industrialist Sanjay Surekha, who was arrested by CBI in Dec 2024 in a bank fraud case, stating that while constitutional courts frown on long detention due to delay in trial, probe in economic offence can be time-consuming.
Justice Suvra Ghosh observed that as many as 444 cases were found to have been pending against Surekha. "There does not appear to be unreasonable delay in investigation, given the fact that probe of economic offences as the present one is time-consuming. In the event the petitioner is released on bail at this stage, chances of his tampering with evidence and influencing witnesses cannot be ruled out."
"It is a fact that the petitioner is in custody since Dec 18, 2024. Constitutional Courts have frowned upon long detention of accused in custody due to delay in investigation/trial. However, investigation pertaining to economic offences involving deep rooted conspiracies and affecting economy of the country, as in the present case, has to be dealt with seriously... ," Justice Ghosh observed.
