• HC quashes son’s case against army man

  • Kolkata: Frowning on a son's involvement in a domestic dispute between his father and maternal grandfather, the Calcutta HC on Friday quashed a criminal case the son had filed against his army-man father over an alleged nasal bone injury from a beating. The court observed that the matter seemed to have arisen from domestic issues between the father and his father-in-law.

    Quashing the case on the ground that no ingredient of offence was found during investigation, Justice Apurba Sinha Ray noted that parental rebuke to children is commonplace in Indian society. The father had approached the court seeking to nullify the FIR lodged by his college-going son at Jamuria in Asansol. He alleged that the complaint, filed in 2024 about an incident said to have taken place in Dec 2020, was lodged at the instigation of the boy's maternal grandfather and uncle.

    The court pointed out that the complaint also accused the father of being greedy and wanting a share of his father-in-law's property. The judge said such allegations indicated external influence.

    In his petition, the father said he had sent his son to a private college in Pune. However, the boy later quit college and moved to Asansol to stay with his grandfather and uncle.

    Justice Sinha Ray concluded that no document established that the father caused the alleged injury and said continuation of the criminal proceedings would be unjustified.
