• Health regulatory body fines nursing home for overbilling, negligence

  • West Bengal Clinical Establishment Regulatory Commission has slapped a fine of Rs 1,44,499 on Belle Vue Clinic for negligence and overbilling relating to two patients, who did in Covid in 2021.

    The commission also instructed the chief executive of Belle Vue Clinic to give a letter of regret.

    Enakshi Sengupta, along with her two daughters Piyali and Kakoli, were admitted to the Belle Vue Clinic with Covid symptoms on 22 April, 2021.

    Piyali Sengupta, the elder daughter, died on 10 May while the mother Enakshi Sengupta died on 27 May. Kakoli Sengupta, the younger daughter, who is a professor at Jadavpur University was released from the hospital after treatment.

    Professor Sengupta later lodged a complaint of medical negligence and overbilling against the Belle Vue Clinic with the West Bengal Clinical Establishment Regulatory Commission.

    The case was heard by Justice (Retd) Ashim Kumar Banerjee and three members, namely, Dr Sukumar Mukherjee, Dr Maitrayee Banerjee and Mrs Madhabi Das.

    The commission found that in case of Piyali Sengupta the nursing home overcharged Rs 34,199 while in case of Enakshi Sengupta Belle Vue Clinic overcharged Rs 1,10,300. The commission instructed the Belle Vue Clinic to return the money to Kakoli Sengupta.

    Professor Sengupta alleged that despite repeated requests, the nursing home authorities did not update her about the condition of her mother and elder sister. She further alleged that she had sent several WhatsApp messages to the chief executive of the nursing home but she did not get any reply. She said despite the commission’s order, the nursing home authorities did not give a letter of regret till date.
