SC upholds HC order, directs govt to give RG Kar posting to Mahata

Kolkata: The Supreme Court on Thursday upheld the Calcutta High Court's decision and ordered that Aniket Mahata be posted at RG Kar Medical College and Hospital in two weeks. The state approached the SC against Calcutta High Court's order of posting Mahata at RG Kar instead of Raiganj Medical College.
Mahata, a prominent face of the RG Kar agitation, moved the single bench of Justice Biswajit Basu, challenging his transfer order to Raiganj Medical College. Justice Basu ordered his posting at RG Kar with immediate effect. Challenging this order, the state had moved SC.
On Thursday, the division bench led by Justice J K Maheshwari observed, "...in the peculiar facts of the case, we are not inclined to entertain the special leave petition and to interfere with the order passed by the High Court. Accordingly, the special leave petition is dismissed. Since the order passed by the High Court is maintained, therefore, compliance now be made within a period of two weeks from today. Pending applications, if any, shall stand disposed of."
Mahata said, "Everyone knows that what the state is doing to me is unjust. Seven months have passed since I completed my MD, and I still haven't been able to join duty. All my time has been spent running to court. I don't know how much longer the govt will take to let me join even after losing in the highest court."
Biplab Chanda, secretary of Medical Service Centre, said, "The state should appoint Mahata immediately as a senior resident." The Joint Platform of Doctors, West Bengal, raised questions on "wastage of taxpayers' money" in hiring lawyers like Sibal. "We demand taxpayers' money be recovered from the state," said Punnabrata Guin, joint convenor of the platform.
