  • Kolkata: A public interest litigation (PIL) against the proposed construction of Humayun Kabir's Babri Masjid, filed in the Calcutta High Court on Thursday was subsequently withdrawn.

    The counsel for the petitioner told a division bench of Acting Chief Justice Sujoy Paul and Justice Partha Sarathi Sen that they sought to withdraw the PIL and file a "properly constituted petition".

    The division bench "made clear that this court has not expressed any opinion on the merits and the tenability of the PIL."

    Petitioner Kaunain Raza had stated in the PIL that the name "Babri Masjid" evoked memories of the sensitive Ayodhya Babri Masjid-Ram Janmabhoomi dispute, which has historically led to communal tensions across India.

    The PIL stated that it was the petitioner's apprehension that proceedings without statutory permissions and oversight could exacerbate communal harmony, threaten public order and violate fundamental rights.
