Kolkata: Delhi is a Union Territory," Calcutta High Court remarked on March 25, rebuking EC's explanation that Delhi was "not similar to other Union Territories" as the poll panel awarded tender for surveillance system in the state election to a company with work experience showing Delhi while rejecting bid of another on the grounds that its work experience included two UTs and not states.
The HC held: "This court finds that the act of EC of India by awarding tender... by rejecting the technical bid of the petitioners is arbitrary and mala fide as in one hand, the authorities have taken into consideration the experience of Delhi, and on the other hand, the experience of the petitioners in Puducherry and Daman is not considered." However, Justice Krishna Rao refrained from interfering with the work orders.
