‘DJ Remark’: Calcutta High Court Refuses Abhishek Banerjee’s Plea Against Voice Sample Collection

Kolkata: The Calcutta High Court on Tuesday refused to entertain TMC MP Abhishek Banerjee’s plea challenging a lower court’s direction of providing his voice sample in connection with the alleged ‘DJ remark’.
Banerjee’s counsel had argued in court that the magistrate’s order was “perverse” and contrary to sections under BNSS. He argued that HC had already granted Banerjee interim protection till July 31 but the same was not disclosed before the magistrate. The counsel argued that when Banerjee had not disputed that it was his voice, “what is the necessity of taking a sample?”
The state opposed the plea, and it was submitted that the challenge was an attempt to avoid cooperation with the probe.
Justice Tirthankar Ghosh held that the petition arose from the same FIR pending before another bench of HC, hence entertaining it would result in conflicting judicial orders.
