  • KOLKATA: The Alipore sessions court has turned down a revision petition by Trinamool Basirhat MP Nusrat Jahan praying to the court to dispense with her appearance in person in a cheating and criminal breach of trust case.

Jahan had been a director of 7 Sense Infrastructure Pvt Ltd, a company that allegedly took money from 429 homebuyers promising them flats at Rajarhat but failed to deliver them.

"I find that there is no infirmity, irregularity or illegality in the court order, nor is there anything prejudicial to the applicant so as to justify any interference in the said order by the court," additional sessions judge Ansuman Chattopadhyay held.

The MP had moved the sessions court against an order of the judicial magistrate on April 5 last year. The magistrate had allowed Jahan's application to dispense with her personal appearance on the condition that she appear on one occasion and file an affidavit and bond, particularly during the framing of charges.

Jahan moved the sessions court seeking removal of the conditions on the grounds that her work as an MP and actor meant she had to travel extensively. In her revision petition, she stated that the impugned order was a gross violation of the judicial process and would ultimately lead to harassment and unjust persecution of the applicant.

TMC spokesperson Kunal Ghosh said: "This is a legal process and a personal issue of Nusrat Jahan. We will not comment at this stage."
