• ‘Press should be allowed to function freely’: HC grants bail to TV journalist booked over Sandeshkhali show

  • Granting bail to a television journalist who was arrested in Sandeshkhali earlier this week, the Calcutta High Court on Thursday observed that the press should be allowed to function freely and independently, without any fear of reprisal or intimidation.

    The journalist, Santu Pan, works for Republic Bangla and was arrested on Monday night on the basis of a complaint filed by a woman alleging that he had trespassed into her house in Sandeshkhali. After his arrest, Pan was remanded in three days of police custody. His arrest had drawn massive criticism from the Editors Guild of India, other press associations, and political parties.

    Justice Kausik Chanda also ordered a stay on further proceedings in the case registered against Pan at Sandeshkhali police station.

    Justice Chanda observed that in the current situation in Sandeshkhali, the freedom of the press is crucial as it serves as the fourth pillar, alongside the executive, legislative, and judicial branches. “This pillar must be allowed to function freely and independently, without any fear of reprisal or intimidation. It is through a free press that the public is informed and empowered, and that the government is held accountable,” the court said.

    Justice Chanda directed that Pan be released on bail upon furnishing a bond of Rs 500 with one surety of like amount. He directed the state to file an affidavit-in-opposition to the journalist’s prayer for quashing of the FIR against him within four weeks and a reply thereto, if any, may be filed by Pan within two weeks thereafter. The court directed that the matter be listed for hearing after six weeks.

    Welcoming the move, Leader of Opposition in state Assembly Suvendhu Adhikari wrote on X: “Fourth pillar of democracy set at liberty owing to the gracious intervention of the Hon’ble Calcutta High Court.
