• Allahabad HC declares UP Madrasa education unconstitutional

  • Allahabad High Court struck down the Uttar Pradesh Board of Madarsa Education Act, 2004, and declared it “unconstitutional” citing that it violates the principles of secularism. A bench comprising Justice Vivek Chaudhary and Justice Subhash Vidyarthi instructed the Uttar Pradesh government to accommodate students enrolled in Madrasas into the formal education system.The Court declared the law ultra vires on a writ petition filed by the petitioner Anshuman Singh Rathore who also challenged the constitutional validity of the UP Madrassa Board. The incident developed months after the state government decided to survey the Islamic educational institutions in the state and also formed a special investigation team (SIT) to probe the madrassa’s funds from overseas.
